The rules and regulations of cannabis law in New York are constantly evolving, and it is important to stay up-to-date on the latest developments. Here are some of the key rules and regulations to be aware of:

  1. No person shall sell, transport, offer for sale, or offer for transport any cannabis in this state without a license issued by the state.
  1. All cannabis sold in the state must be labeled under state law.
  1. No person shall sell, transport, offer for sale, or transport any cannabis to anyone under the age of 21.
  1. No person shall sell, transport, offer for sale, or transport any cannabis in an amount greater than one ounce.
  1. No person shall cultivate, grow, or produce any cannabis in this state without a license.
  1. All cannabis cultivated, grown, or produced in the state must be labeled in accordance with state law.
  1. No person shall cultivate, grow, or produce any cannabis in an amount greater than four ounces.

Age restrictions for Cannabis marketing strategies

The Cannabis Act outlines some significant restrictions on cannabis advertising, promotion, and sponsorship. The restrictions are similar to those that apply to tobacco products and advertising.

The Cannabis Act prohibits cannabis advertising, promotion, and sponsorship that:

  • Appeals to young persons
  • Depicts a character, or person, whether real or fictional or who is represented to be under 25 years of age.
  • It depicts a lifestyle that includes cannabis.
  • It is associated with or produces a positive or negative emotion about life, such as including glamour, recreation, risk, or daring.
  • It is presented in a manner that evokes a negative or positive emotion about the use of cannabis.
  • It is presented in a manner that there are valid grounds to believe could be demanding to young persons.
  • In addition to the above, cannabis advertising, promotion and sponsorship cannot:
  • Include endorsements or testimonials.
  • Include false or misleading information.
  • Make claims that it has benefits that have not been proven by science.
  • Make claims that are based on scientific evidence that is inconclusive or that have not been published in a peer-reviewed journal.
